Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the YauzaiSafar mobile application and any related services (collectively, the "Platform"). By creating an account, posting a ride, booking a seat, or using any feature of the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

For clarity, the following definitions apply throughout these Terms:

• "User" means any individual who creates an account and uses the Platform, whether as a ride creator, a passenger, or both.
• "Platform" means the YauzaiSafar mobile application, website, and any associated technology or services operated by YauzaiSafar.
• "Ride" means a travel arrangement created by a User on the Platform, offering available seats to other Users for a specified route, date, and time.
• "Ride Creator" means a User who creates a Ride listing and offers seats to other Users.
• "Passenger" means a User who books or joins a Ride created by another User.

YauzaiSafar reserves the right to modify these Terms at any time. Continued use of the Platform after any update constitutes your acceptance of the revised Terms.

Specifically, YauzaiSafar:

• Does not provide, operate, or control transportation services.
• Does not own or operate any vehicles.
• Does not employ, engage, or act as an agent for any Ride Creator or Passenger.
• Does not verify the accuracy of ride listings, user identities, or vehicle details.
• Does not guarantee the safety, legality, timing, pricing, or availability of any Ride.
• Does not control or guarantee the behaviour, conduct, or reliability of any User.
• Does not guarantee that a Ride will be completed as described.

Every Ride arrangement — including agreement on route, timing, cost, and terms of travel — is made directly between Users. YauzaiSafar provides the technology that enables this coordination; the decisions and actions that follow are entirely between the Users involved.

To use the Platform, you must create an account. You must be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher. By creating an account, you confirm that you meet this requirement and have the legal capacity to agree to these Terms.

When creating and maintaining your account, you must:

• Provide accurate, complete, and truthful information — including your name, email address, mobile number, and WhatsApp number.
• Keep your account information current and up to date.
• Keep your login credentials secure. You are responsible for all activity that occurs under your account.
• Not create more than one account without our prior written permission.
• Not create an account on behalf of another person without their explicit consent.
• Not impersonate any individual or entity.

YauzaiSafar may suspend, restrict, or permanently remove accounts that violate these Terms, provide false information, or engage in behaviour that harms other Users or the Platform.

When you create a Ride listing on YauzaiSafar, you are responsible for the accuracy and completeness of all information you provide. You must include:

• Accurate starting location and destination.
• Correct route details, where relevant.
• Accurate travel date and departure time.
• Honest vehicle information (where applicable).
• The correct number of available seats.
• Any other information required to allow Passengers to make an informed decision.

You must update or remove your Ride listing promptly if details change, the Ride is cancelled, seats become unavailable, or information becomes inaccurate. Posting misleading, false, or outdated listings is a violation of these Terms and may result in account suspension.

By publishing a Ride, you represent that your travel arrangements comply with all applicable laws in your location and that you have the legal ability to offer seats to other Users.

When you book or join a Ride on YauzaiSafar, you enter into a travel arrangement directly with the Ride Creator. This does not create any employment, agency, or contractual relationship between you and YauzaiSafar.

• You are responsible for verifying all Ride details — including route, timing, pickup location, and cost — directly with the Ride Creator before travelling.
• You acknowledge that YauzaiSafar does not verify the accuracy of Ride listings or the identity of Ride Creators.
• Ride Creators may accept or decline booking requests at their own discretion. YauzaiSafar does not guarantee that any booking request will be accepted.
• Cancellation of a confirmed booking should be communicated to the other party as early as possible. YauzaiSafar is not responsible for disruptions caused by cancellations made by either party.

Any dispute arising from a booking — including disagreements over route, timing, cost, or conduct — is between the Users involved. YauzaiSafar does not mediate, arbitrate, or resolve disputes between Users.

After a Ride booking is confirmed, YauzaiSafar may make contact information — including mobile numbers and WhatsApp numbers — available between the relevant Users to allow them to coordinate their travel.

• Contact details shared through the Platform are provided solely for the purpose of coordinating the specific Ride in question.
• You must not use another User's contact information to harass, spam, threaten, or contact them for any purpose unrelated to the Ride.
• Once contact information is exchanged and communication moves to WhatsApp or another channel, YauzaiSafar has no visibility into, control over, or responsibility for any messages, calls, or agreements that take place.
• The WhatsApp contact feature on the Platform opens a WhatsApp conversation on your device. This action is initiated by you. Your use of WhatsApp is governed by WhatsApp's own terms and privacy policy.

YauzaiSafar is not responsible for disputes, misunderstandings, or harm arising from direct communication between Users outside the Platform.

YauzaiSafar may use your device's GPS location during an active trip to provide live tracking for the Users participating in that Ride, and may request a one-time location reading when you create a Ride or passenger request.

• Live location is collected only while a trip is in an active state — after the journey has started and until it is marked as complete or cancelled — and is used to share pickup and drop-off progress with the other trip participant.
• Your live location is visible only to the Ride Creator and confirmed Passengers participating in that specific trip.
• Live location data is not stored as a permanent record and is cleared at or shortly after trip completion, or when location sharing is turned off.
• When creating a Ride or passenger request, YauzaiSafar may request a single, one-time location reading solely to auto-detect your country and currency for the form. This reading is not stored as a location history.
• Location access is requested through your device's standard permission prompt. You can deny or revoke it at any time in your device settings. Doing so disables live tracking and the auto-detect feature, but does not prevent you from posting, browsing, or booking Rides.

All Users are responsible for how they use YauzaiSafar and how they treat other Users. By using the Platform, you agree to the following:

• You will provide accurate and truthful information at all times.
• You will use contact information shared through the Platform only for the purpose of coordinating the relevant Ride.
• You will treat all other Users with respect.
• You will not harass, threaten, intimidate, discriminate against, or abuse any other User.
• You will not use the Platform for any illegal activity, including illegal commercial transport operations.
• You will not create fake or duplicate accounts.
• You will not impersonate another person or entity.
• You will not attempt to misuse, disrupt, reverse-engineer, or damage the Platform or its infrastructure.
• You will comply with all applicable laws and regulations in your jurisdiction.

Violations of these responsibilities may result in immediate account suspension or permanent removal from the Platform.

In addition to the general responsibilities in Section 8, users travelling as Passengers have the following specific responsibilities:

• Confirm all Ride details directly with the Ride Creator before committing to travel, including the route, meeting point, departure time, and any cost arrangement.
• Provide accurate pickup and drop-off information so the Ride Creator can plan accordingly.
• Be ready at the agreed pickup point at the agreed time. The Ride Creator is not obligated to wait beyond what has been agreed.
• Respect the Ride Creator's vehicle and any rules they have set for the journey.
• Communicate any changes or cancellations to the Ride Creator as early as possible.
• Make your own safety judgment before joining any Ride. If anything about a Ride or Ride Creator feels unsafe or unclear, you are not obligated to travel.

Users who create Ride listings ("Ride Creators") are not employees, agents, or contractors of YauzaiSafar. They are independent individuals coordinating travel with other Users. In addition to the general responsibilities in Section 8, Ride Creators have the following specific responsibilities:

• Ensure that all information in a Ride listing — including route, timing, vehicle details, and available seats — is accurate and kept up to date.
• Communicate clearly and respectfully with Passengers before, during, and after the Ride.
• Notify Passengers of any changes or cancellations promptly and as early as possible.
• Ensure that your travel arrangement complies with all applicable laws and regulations in your location, including any requirements related to carrying passengers.
• Not represent yourself as employed by or acting on behalf of YauzaiSafar in any communication with Passengers or third parties.

YauzaiSafar does not train, supervise, or direct Ride Creators. The decision to create a Ride and how to conduct that Ride is entirely the Ride Creator's own.

YauzaiSafar does not process, handle, facilitate, or collect payments between Users. Any cost-sharing, contribution, fare, or payment arrangement made in connection with a Ride is agreed upon and handled directly between the Users involved, entirely outside the Platform.

• Users are solely responsible for agreeing on cost, payment method, timing, and any refund or cancellation terms before the Ride takes place.
• YauzaiSafar is not a party to any financial agreement between Users and assumes no liability for unpaid amounts, refund disputes, or payment-related disagreements.
• If YauzaiSafar introduces a payment feature in the future, separate terms specific to that feature will apply and users will be notified.

Shared travel involves real-world interaction between individuals. YauzaiSafar strongly encourages all Users to take reasonable precautions:

• Verify the details of a Ride — including the identity of the other party, the vehicle, and the meeting point — before committing to travel.
• Arrange to meet in public, well-lit locations where possible, especially when meeting another User for the first time.
• Inform a trusted person of your travel plans, including who you are travelling with and your expected route and arrival time.
• Trust your own judgement. If anything about a Ride, Ride Creator, or Passenger feels unsafe, unclear, or suspicious, you are under no obligation to proceed.

YauzaiSafar recommends these practices but cannot guarantee your safety. You travel at your own risk and are responsible for making decisions that are right for your own safety and wellbeing.

The following activities are strictly prohibited on YauzaiSafar. Engaging in any of these may result in immediate account suspension, permanent removal, or referral to relevant authorities:

• Posting false, misleading, or fabricated Ride listings.
• Creating fake or multiple accounts to deceive other Users or the Platform.
• Impersonating another individual, organisation, or entity, whether real or fictional.
• Using the Platform to harass, threaten, intimidate, or discriminate against any User based on any characteristic.
• Collecting, scraping, or harvesting personal information of other Users for any purpose not directly related to coordinating a specific Ride.
• Using the Platform or data obtained from it for unauthorised commercial purposes, including operating an unlicensed transport business.
• Attempting to access, damage, disrupt, or reverse-engineer any part of the Platform or its infrastructure.
• Conducting or facilitating fraud, scams, or financial deception through the Platform.
• Posting, transmitting, or distributing illegal, offensive, or harmful content through the Platform.
• Using the Platform for any activity that violates applicable law.

YauzaiSafar reserves the right to suspend, restrict, or permanently terminate any User's access to the Platform at its discretion, with or without prior notice, if we reasonably believe that the User:

• Has violated any provision of these Terms.
• Has provided false or misleading information.
• Has engaged in behaviour that may harm other Users or the Platform.
• Has used the Platform for fraudulent, illegal, or abusive purposes.
• Has misused another User's contact information or personal data.
• Poses a risk to the safety or wellbeing of other Users.

YauzaiSafar may also remove any Ride listing, booking record, or content that violates these Terms or that we consider inappropriate, harmful, or misleading.

You may permanently delete your own account and data at any time using the "Delete Account" option on your Profile screen — this takes effect immediately and cannot be undone. If you are unable to access the app, you may request deletion by emailing info@yauzaisafar.com from your registered address. Please review our Privacy Policy for full details on how account data is handled upon deletion.

To the maximum extent permitted by applicable law, YauzaiSafar and its operators, directors, employees, and agents will not be liable for:

• Any action, conduct, or agreement between Users.
• Any accident, personal injury, property damage, or loss arising from a Ride arranged between Users.
• The accuracy, reliability, or legality of any Ride listing posted by a User.
• The cancellation, delay, or non-completion of any Ride.
• Any financial dispute, unpaid cost, or payment-related disagreement between Users.
• Any harm caused by communication between Users outside the Platform.
• Any service interruptions, data loss, or technical errors on the Platform.
• Any content, communication, or conduct originating from a third-party service, including WhatsApp.

The Platform is provided "as is" and "as available." YauzaiSafar makes no warranties, express or implied, regarding the accuracy, completeness, availability, fitness for a particular purpose, or security of the Platform. Nothing in these Terms limits liability that cannot be excluded under applicable consumer protection law.

You agree to defend, indemnify, and hold harmless YauzaiSafar and its operators, officers, employees, and agents from and against any claims, losses, damages, costs, or liabilities — including reasonable legal fees — arising out of or in connection with:

• Your use of the Platform in violation of these Terms.
• Any Ride listing you create, booking you make, or arrangement you enter into with another User.
• Any misuse of another User's personal information, contact details, or content.
• Any claim brought by a third party arising from your conduct on or through the Platform.
• Any violation of applicable law in connection with your use of the Platform.

This obligation survives the termination or deletion of your account.

The YauzaiSafar name, logo, application design, software, technology, and all associated content and materials are the intellectual property of YauzaiSafar or its licensors. Nothing in these Terms grants you any right to use, copy, reproduce, modify, distribute, or create derivative works from YauzaiSafar's intellectual property without our express written permission.

You must not:

• Copy, reproduce, or redistribute any part of the Platform or its content.
• Use the YauzaiSafar name, logo, or branding for any commercial purpose.
• Reverse-engineer, decompile, or extract any source code or software from the Platform.
• Create any tool, application, or service that scrapes, mirrors, or impersonates any part of the Platform.

Content you post on the Platform — such as Ride listings and profile information — remains yours. By posting it, you grant YauzaiSafar a non-exclusive, royalty-free licence to display, store, and process that content solely for the purpose of operating the Platform.

Your use of YauzaiSafar is also governed by our Privacy Policy, which explains what personal information we collect, why we collect it, how it is used, who it is shared with, and what rights you have over it. Please read the Privacy Policy carefully — by using the Platform you acknowledge that your information is handled as described there.

Key privacy points to be aware of:

• Contact information is shared only between confirmed Ride participants.
• Live location is collected only during active trips and shared only with trip participants; a one-time location reading may also be used to auto-detect your country and currency.
• We use a device push token, via Expo and (on Android) Google Firebase Cloud Messaging, to send booking-related alerts.
• Map tile images for trip maps are loaded from OpenStreetMap and Carto.
• We do not sell your personal data.
• You can permanently delete your account and data at any time via in-app self-service deletion, or by emailing us if you cannot access the app.

YauzaiSafar may update these Terms from time to time as the Platform evolves or as legal requirements change. When we make updates, we will:

• Update the "Last updated" date at the top of this document.
• For significant changes, notify registered Users via email or an in-app notice before the change takes effect.

Continued use of the Platform after any update to these Terms constitutes your acceptance of the revised Terms. If you do not agree to updated Terms, you must stop using the Platform. You can request account deletion as described in Section 14.

These Terms are governed by and construed in accordance with the laws of Pakistan, without regard to conflict of law principles. If you are accessing the Platform from a jurisdiction with its own mandatory consumer protection laws, those laws may also apply to the extent required by local legislation.

Any dispute arising from or relating to these Terms or your use of the Platform that cannot be resolved informally should be submitted to the competent courts of Pakistan, unless applicable law requires otherwise.
